Terms of Service

1. Acceptance of Terms

By accessing or using ForeverUs ("the Service"), operated by Vintage Vows, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms apply to all users, including visitors, registered users, and paying customers.

2. Service Description

ForeverUs provides a wedding website builder platform that allows couples to:

• Create customizable wedding websites
• Manage guest RSVPs
• Share photos and wedding details
• Use additional features based on selected plan (Essentials, Plus, or Premium)

3. User Accounts

3.1 Account Creation: You must create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Accuracy: You agree to provide accurate, current, and complete information during registration and to update it as necessary.

3.3 Account Security: You are responsible for all activities under your account. Notify us immediately of any unauthorized access.

3.4 One Account per Wedding: Each wedding is entitled to one account. Multiple accounts for the same wedding are not permitted.

4. Pricing and Payment

4.1 Plans: ForeverUs offers three plans: Essentials (Free), Plus (R490 one-time), and Premium (R950 one-time).

4.2 Payment Terms: All prices are in South African Rand (ZAR) and are one-time payments. Payment must be completed before your website is published.

4.3 No Refunds: All purchases are final. We do not offer refunds except as required by South African consumer protection laws.

4.4 Price Changes: We reserve the right to change our pricing at any time. Price changes will not affect existing paid accounts.

5. Content and Intellectual Property

5.1 Your Content: You retain all rights to content you upload (photos, text, etc.). By uploading content, you grant us a license to store, display, and transmit your content as necessary to provide the Service.

5.2 Prohibited Content: You may not upload content that is illegal, offensive, defamatory, or infringes on third-party rights.

5.3 Our Platform: All rights, title, and interest in the ForeverUs platform, including design, templates, and software, remain our property.

5.4 Content Removal: We reserve the right to remove any content that violates these Terms or is otherwise objectionable.

6. Website Management and Archiving

6.1 Website Duration: Your wedding website remains active according to your plan. We recommend downloading important data before your wedding date.

6.2 Archiving: Websites may be moved to "completed" status after the wedding date. Completed websites may be archived or deleted at our discretion with prior notice.

6.3 Data Export: You can export your guest list and RSVP data at any time through your dashboard.

7. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Impersonate others or provide false information
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to our systems
• Use automated systems (bots, scrapers) without permission
• Resell or redistribute the Service

8. Service Availability

8.1 Uptime: We strive to maintain high availability but do not guarantee uninterrupted service.

8.2 Maintenance: We may perform scheduled maintenance with advance notice when possible.

8.3 Modifications: We reserve the right to modify or discontinue the Service (or parts thereof) with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by law, ForeverUs and Vintage Vows shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or uninterrupted.

11. Indemnification

You agree to indemnify and hold harmless ForeverUs, Vintage Vows, and their affiliates from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

12. Termination

12.1 By You: You may terminate your account at any time by contacting us. No refunds will be provided.

12.2 By Us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion.

12.3 Effect of Termination: Upon termination, your website will be removed, and you will lose access to your data unless you have exported it.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.
